Frequently Violated Laws
Current surveys report there has been a dramatic increase of
tobacco and alcohol use by youth, (tobacco use almost doubled
from 1991 to 1995 and 33% of High School youth reported
"binge" drinking). Based on these alarming
numbers, the Wheeling Police Department has taken the initiative
in preventing our youth from becoming just another statistic.
As part of this initiative, we are asking parents and citizens
to review the
Village Code
regarding issues of possession of
tobacco and alcohol by minors, curfew and unlawful assembly.

No minor under eighteen years of age shall purchase,
attempt to purchase, or possess any cigar, cigarette or tobacco
in any of its forms.

Except as provided in Section 8.04.190, it is
unlawful for any person under the age of twenty-one years to
purchase, obtain or otherwise possess any alcoholic liquor.

assembly by underage persons

It is unlawful for any person under the age of twenty-one
years to remain in any motor vehicle, conveyance, vessel, house,
apartment, room, hotel room, shed, yard, premises or other area
when said person knows, or reasonable should know, that one or
more other persons under the age of twenty-one years located in
such motor vehicle, conveyance, vessel, house, apartment room,
hotel room, shed, yard, premises or other area are in possession
of any cannabis or controlled substance prohibited by Illinois
statute, or in possession of any alcoholic liquor.

It is unlawful for any person who has ownership or control of
any premises to knowingly allow two or more persons under the
age of twenty-one years to assemble or be assembled on such
premises, in possession of any alcoholic liquor.

Parental responsibility. It is unlawful for any person,
including a parent or legal guardian, to knowingly cause, aid,
encourage or permit any underage person to violate or attempt to
violate any federal or state law or municipal ordinance or to
knowingly act in such a manner as to directly tend to cause or
permit an underage person to violate or attempt any federal or
state law or municipal ordinance.

The parent or legal guardian of an unemancipated minor
who has custody of such minor shall be liable for any fine,
condition of restitution or reparation imposed by a court upon a
minor for a violation of any provision of the Wheeling Municipal
Code; provided, the minor has not paid the fine or made
restitution or reparation within the time ordered by the court;
and further provided, that said parent or guardian has been
served with summons or notice to appear in the original cause
and all proceedings thereafter as provided by law.

It is unlawful for any minor (under the age of 18) to
be present at or upon any public assembly, building, place,
street or highway at the following times unless accompanied and
supervised by a parent, guardian or other responsible companion
at least twenty-one years of age approved by a parent or
guardian, or unless engaged in a business or occupation which
the laws of this state authorize a minor to perform:
- Between 12:00am and 6:00am Saturday;
- Between 12:00am and 6:00am Sunday; and
- Between 11:00pm on Sunday to Thursday inclusive and
6:00am the following day.
